AI Copyright Lawsuits: Is Fair Use Enough?

Are AI companies legally using copyrighted content? Explore the latest rulings on AI copyright lawsuits and what they mean for the future of fair use.

The big question in AI copyright lawsuits is simple: is training language models with copyrighted content fair use, or does it break copyright rules? This is a fight between two main ideas – making new things and protecting ownership of ideas. What happens next could change how AI develops in the future.

US copyright law has a rule called fair use. This rule lets people use copyrighted material without asking, but only in certain cases. It works especially if the new use is different from the original. This could be for comments, reviews, news, research, or teaching. People who support AI developers say training AI models fits this rule. They say the computer program doesn't just copy content. Instead, it looks at lots of data to find language patterns. Then it makes completely new responses that don't look much like any one original text.

But, people who don't like this – mainly writers, publishers, musicians, and artists – say using copyrighted work to train AI without permission or payment breaks their rights. They say companies are using their work to make money without giving anything back to the people who made it. They think AI outputs come from data used without permission. And this hurts how they make money and hurts the whole creative field.

And this problem is causing many new lawsuits. These cases are trying to figure out the legal limits for “fair use AI”. This idea is becoming very important in courts and when talking about rules.

Anthropic won in court. This was one of the first and biggest wins for AI companies. But what this means goes way past just this one case.

In June 2025, Judge William Alsup said that Anthropic didn't break copyright rules by using copyrighted books to train its large language model, Claude. He said that what Anthropic made – a smart AI that understands and makes human language – was very different from the books it learned from.

Also, Alsup decided that the AI system could look at data and make new kinds of text. He said this was a use that clearly did not break copyright rules. He also saw the idea of making something different in a wide way. He said Anthropic wasn't just taking book content and putting it in a new form or rewording it. Instead, it was using text data to make a completely new kind of smart system.

But, even though the judge ruled for the company, this did not take away future legal risks. Every case still depends on its own specific facts. Alsup’s ruling did not set a big rule for everyone. This means new lawsuits could turn out differently. It all depends on small differences in how the data was used and how the model acts.

Case 2: Meta’s Narrow Victory — Market Harm as the Deciding Factor

Meta won its case too, but for a different reason and in a separate lawsuit.

On June 25, 2025, Judge Vince Chhabria said that 13 authors who sued Meta could not prove that Meta’s model hurt their money. Meta had used their works when training the model. Judge Chhabria did not look at how different the new work was (like Alsup did). Instead, he looked hard at one of the four main things to check for fair use: if the use might hurt the market for the original work.

📉 “Whether allowing people to do that sort of thing would greatly hurt the market for the original,” Chhabria noted [(Chhabria, 2025)].

He thought the authors could not show that using their work to train Meta’s models stopped them from making money from their own newer works or from selling licenses. They couldn't prove “market harm”, so the decision went towards Meta.

And again, the judge’s decision still leaves the door open for future payments if harm is proven later. Chhabria clearly said this lawsuit wasn't a class action. It only covered a small set of facts: “The results of this ruling are limited.”

This difference is important. Bigger class actions, prepared more carefully, might lead to very different results.

Why These Rulings Matter — But Don’t Resolve Everything

These two decisions do show that AI companies have a point about fair use. But, they also show how unclear the rules for AI copyright still are. These were not big decisions that set rules for everyone. The judges just looked at the specific cases. Their decisions were based on what the authors said, what the judges thought, and what proof was missing.

The rulings did not give AI developers full permission to use copyrighted works. And they did not say that training AI models on this data is okay in all cases. So, the questions about this are still not answered. Every new case might bring up a new situation, happen in a different place, or use new kinds of data. This could be images, music, or computer code. And this might make the rules unclear again.

Simply put, this is just the start of a long period of legal cases where the rules might keep changing.

Dozens More Cases in Progress

The decisions for Meta and Anthropic just made this topic more active and important. Today, over 40 AI copyright lawsuits are going through state and federal courts. Many different people and groups are suing, from single authors to big international media companies. They are suing large tech companies like Google, OpenAI, IBM, Microsoft, and Midjourney.

Big names suing now include:

  • Getty Images, suing over billions of photos copied without permission.
  • The New York Times, saying its text articles were used wrongly in model training.
  • Universal Music Group and other labels, worried about “deepfakes” and AI music that sounds like real artists.

Lawyer Amir Ghavi, who works for some Silicon Valley companies, said: “There is still a long way to go before the issue is settled by the courts” [(Ghavi, 2025)]. And as people ask higher courts to look at cases and new lawsuits start, each decision could help figure things out – or make things harder – for AI’s place in the creative world.

Even if AI companies manage to defend using copyrighted work under fair use, they might still have trouble with where and how they got that work.

Both Meta and Anthropic are being looked at more closely. People claim some of their training data came from online files that were not allowed or were stolen. If this is shown to be true, it could be another reason for legal trouble. This is true even if using the content was seen as okay because it was changed a lot.

For example, Anthropic is likely going to a second trial. This trial will check if it got data from illegal places like secret online book sites. At the same time, Meta has been told to talk with the authors who sued. They need to discuss how to maybe fix the training data and plans to reduce problems.

If courts find that companies built training datasets knowing they were doing wrong or not being careful, those companies could face problems. They could be stopped from doing things, have to pay money to the people who own the rights, or even be told to train their AI again using data they paid for or free, open data.

The point is clear: things being legal doesn’t start with what the model makes. It starts with where the data comes from.

Why This Matters for Developers

While most of the legal attention is on huge companies like OpenAI or Google, what happens matters just as much for normal developers and companies using these tools.

For example, suppose a model trained on data that breaks rules makes creative work. And suppose that work ends up in your software, guides, or ads. You could get sued too. Even if there are no lawsuits, just having people think badly of your product could hurt it.

Think about these questions:

  • Can you see where the training data came from for the AI tools you use?
  • Does your software automatically put AI-made content into code, guides, or user screens?
  • Could your product accidentally copy copyrighted language or styles?

With all these legal issues, using AI the right way is not just about what it can do. It is about managing risk.

Compliance Concerns: What Devs Should Watch For

To get through this situation, developers need to be more careful about where AI output comes from.

Here are some steps to think about:

  • ✅ Check what you use: Find out which AI services or data collections you depend on.
  • 📝 Keep records of what the AI makes and how plugins were used.
  • 📜 Read the rules: Check the terms and license papers for any AI product.
  • 🔎 Check the companies you buy from: Try to use AI companies that show you where their training data came from and offer to protect you legally.

In the end, you should check AI tools just as carefully as any other piece of software you get from somewhere else. The more important they are to your product, the more you need to be sure about the legal side.

While courts keep figuring out the details of AI fair use, the companies are already changing how they do things to avoid problems.

We will probably see a future with licensing deals. AI companies will make agreements with big media groups, writer groups, and places that store images and art. OpenAI has already made big licensing deals with Axel Springer and the Associated Press. Look for more of these partnerships. They are meant to build data collections that are “clean” and can be used safely for future models.

This change will affect many things:

  • 🎯 Different levels of access: Models trained on special data might give better results but cost more money.
  • 🔐 Rules about being approved: Developers might need to ask for proof (or show proof themselves) that the data follows rules for products used by big companies.
  • 💡 How the market works will change: Licensing rules could create a new system of “AI data brokers”.

And it could help calm down some of the anger from creative people. It would show respect and pay the people who made the original content.

Impacts on Open Source and Developer Tools

Another group really affected by these changes is the world of open-source software.

Code stored on sites like GitHub, GitLab, and Bitbucket is often used to train AI. People often just assume that because it’s open, it’s free to use any way they want. But licenses like GPL or Apache often have rules that might not allow training models without saying where the code came from.

So, developers have started putting in ways to opt out, notes in their project files, or even tricks to mess up the data. They do this to stop computer programs that crawl the web from taking their code for AI model training.

The question everyone is asking more now is: should code shared openly – made for people to use and work together – be used to train AI systems that companies sell, with almost no one checking?

And this conflict between the open way of sharing and company-owned AI might cause people to push back. Or it could lead to changed licenses or new open-source models made so they aren't specially good for training AI.

The Ethical Layer: Creators vs. Corporations

On top of following the law and getting licenses, there’s a bigger question: is it right to make content with AI, and what happens to the skill of human creators?

Many creative people say their hard work is being taken into AI systems. They get no mention, no money, not even a nod. This isn’t just about the law. It’s about respect, who you are as a creator, and being able to make a living.

Tyler Chou from the law firm Tyler Chou Law for Creators said: “The next wave of plaintiffs… will arrive with deep pockets. That will be the real test of fair use in the AI era” [(Chou, 2025)].

In the end, developers making the next tools need to think hard about these questions. Am I making what humans can do better—or taking their place? Is this use giving people power—or just using them unfairly?

Thinking carefully about how you design things can help make sure AI development works well with people doing well.

The Broader Implications for Innovation

What happens in these legal fights will show what’s next for making new technology. If rules get very strict, new AI companies might slow down or stop because they are scared of lawsuits. But, if people can use creative work freely, it could take away the reasons for people to make new writing, code, designs, and news stories.

It's very important to find a balance between protecting creators and making progress. This is not an either/or question. It’s a range of possibilities. It needs deep legal thinking, thinking about what’s right, and plans for the future.

What Developers Can Do Now

Because things are not clear, developers are very important in helping to make an AI system that works for everyone and follows the law.

To help your work be okay in the future, think about these steps:

  1. 📂 Use AI models that show where their data came from. Use ones trained on data that was paid for or is free to use.
  2. 🎓 Teach your team about AI fair use and why it matters where data comes from.
  3. 🧾 Keep records of what the AI makes, especially when it’s important (like when adding code to projects or showing things to clients).
  4. 👥 Help or join groups that work on making AI the right way, thinking about new ideas and the rights of creators.
  5. ⚖️ Talk to lawyers when you put AI systems from other companies into your products.

So, by making sure you use AI from places that are okay ethically and legally, you lower your risks for the future. You can still use the big power of tools that make new things.
